Terms of Service
Effective October 21, 2026
These terms are an agreement between you and Can I Watch This Please, LLC (“Book This Please,” “we,” “us”), 1 N 4th Pl, Brooklyn, NY 11249, for the Services. If you do not agree, do not use the Services.
An instructor is our customer: a person or business that offers classes or other services through Book This Please. A client is a person who books, buys, or joins a waitlist with an instructor. The Services are the websites, booking pages, admin tools, mobile apps, and related features we offer now or add later, including at bookthisplease.com and on domains instructors connect.
The Services may include the features described below. Not every feature is available to every instructor or client, and a feature described here may be offered now or in the future. What you see in the product at the time you use it is what is available to you.
Bookings and waitlists
A booking is a reservation or purchase with an instructor, such as a spot in a class. The name, time, place, price, and other terms are shown before you confirm. A booking is confirmed when the Services say it is, which may be when payment succeeds or when a free booking is accepted.
The Services may include waitlists. Joining a waitlist does not reserve a spot and does not charge you unless the page says it does. If a spot opens, we or the instructor may offer it to you on the terms shown then. The instructor can set the size of a class, close booking, or cancel a session.
Cancellations and refunds
Cancellations and refunds follow the instructor’s own policy, shown before you book or pay. That policy may include a deadline before the class, a full or partial refund, a credit, or no refund. If the instructor has not chosen a policy, the default shown in the Services at the time of booking applies. The policy in effect when you book is the one that applies to that booking.
The instructor may refund a client after purchase. If an instructor cancels a session, the remedy is what that instructor’s policy and the checkout terms describe, which may include a refund to the original payment method or a credit. Nothing here limits a right you have under law that cannot be waived.
Payments, credits, memberships, and promotions
The Services may include one-off payments, class packs and other prepaid credits, memberships and other recurring subscriptions, discount codes, promotions, referral credits, and gift cards. The price, what you receive, any expiry, and any limit are shown before you pay.
Prepaid credits, including class packs, are for the instructor who sold them unless the offer says otherwise. They are not cash, are not a bank account, and may expire on the date shown before purchase. Unused credits expire at that time. Whether unused credits are refundable is what the offer said at purchase. If it did not promise a refund, unused credits are not refunded, except where the law requires one.
A membership or other subscription renews automatically for the period and price shown at signup, until you or the instructor cancels. How to cancel is shown before you subscribe and in the product. Cancellation stops future renewals. It does not refund a period that has already started, unless the offer or the law says it does. If a renewal payment fails, we or the instructor may retry the charge, pause benefits, or end the subscription, as shown in the product.
Discount codes, promotions, referral credits, and gift cards have the value, limits, and expiry shown when they are offered. They have no cash value except where the law requires it. We or the instructor may refuse or reverse them if they are misused, expired, or issued in error.
Fees
Use of the Services may involve platform fees and subscription fees, now or in the future. Any platform fee is shown before you pay. We may introduce or change fees. A new fee does not apply to a purchase already made, and we will show the fee that applies before you pay again.
Payments are processed by Stripe. The instructor pays Stripe’s standard processing fees by default, and may pass those processing fees on to clients. When a processing fee is passed through, the amount is shown before the client pays. Processing fees are not returned when a charge is refunded. Payouts for an instructor’s sales are sent to the Stripe account the instructor connects. The instructor is responsible for the accuracy of that account.
By using payouts, the instructor agrees to the Stripe Connected Account Agreement.
Saved payment methods and off-session charges
The Services may include a saved payment method on a client’s Book This Please account, now or in the future. That account and any saved card are shared across instructors and across domains on the Services, including a domain an instructor connects. Saving a card is optional. With the client’s consent, a saved card may be charged off-session for a booking the client confirms in one tap with any instructor, and for late-cancel and no-show fees under the policy of the instructor whose class it is. The amount and the reason are the ones in that instructor’s policy and the ones shown at the time of the charge. The client can remove a saved card as the product allows.
Pages, domains, and apps
The Services may include an instructor website, a branded booking page, a custom domain, and a mobile app. We may offer some of these now and others later, and some may require a paid plan shown before you start it. A custom domain remains the instructor’s. The instructor is responsible for keeping domain settings and any app-store accounts in good standing. We may display Book This Please branding alongside an instructor’s brand.
AI features and imported content
The Services may include AI-assisted features, now or in the future. Those features may help with setup, generate or edit content, answer questions, or run assistants and agents that act for an instructor at the instructor’s request. They may use content the instructor uploads or imports, including from a social media account the instructor connects.
AI output can be wrong, incomplete, or similar to other people’s content. The instructor is responsible for reviewing anything before it is published or sent to clients, and for having the right to use imported material. An agent acts on the instructor’s instructions and within the tools we make available. It does not make the instructor’s legal, tax, or safety decisions. Do not rely on an AI feature as professional advice.
Third-party services
The Services may connect to third parties, such as payment, email, messaging, calendar, domain, social, analytics, and AI providers. Connecting an integration is optional. The third party’s own terms and privacy policy govern their service. We are not responsible for a third party’s outage or for how they handle information under their own terms. We may add or remove integrations.
Communications
Transactional email and account notices are part of the Services. We may send those without a separate opt-in, including booking emails, receipts, and security messages such as a sign-in code. SMS of any kind is sent only with your explicit opt-in. That includes booking texts, reminders, waitlist updates, and any other text. Marketing messages, by email or by text, require separate consent. You can opt out of marketing without losing transactional email. Opting out of SMS does not cancel a booking. Consent to texts is not a condition of purchase or booking. Message frequency varies. Msg & data rates may apply. Details, including STOP and HELP, are on the SMS page. Carriers are not liable for delayed or undelivered messages.
The instructor’s responsibilities
The instructor is the seller of the classes and other offerings they list, and is the merchant of record for those sales. Card statements show the instructor. Book This Please facilitates the payment through Stripe Connect: we collect the charge and remit the instructor’s proceeds on the instructor’s behalf. We are not the seller of the class. We may reverse transfers, offset future payouts, and debit the instructor for refunds, disputes, chargebacks, fees, and negative balances. The instructor, not Book This Please, is responsible for:
- The class or service itself, including the description, the schedule, the location, instruction, and whether it runs.
- Cancellations, refunds, credits, and customer service under the policy they show to clients.
- Disputes and card chargebacks about their offerings, and for cooperating with the payment processor and with us when a dispute is filed.
- Taxes on their sales, and for any license or permit their business needs.
- Any liability waiver or other agreement they ask a client to accept for physical activity. That waiver is between the client and the instructor. We are not a party to it unless we expressly say so.
Assumption of risk
Fitness classes and similar activities involve physical exertion and an inherent risk of injury, illness, or worse, including risks from equipment, premises, other participants, and the client’s own condition. Participation is voluntary. The client assumes those risks. Book This Please does not supervise classes, does not provide medical advice, and does not guarantee that a class is safe or suitable for any person. Clients should consult a qualified health professional before starting exercise, and should not participate against medical advice. Instructors are responsible for how they teach and for any waiver they require.
Your content
You keep ownership of content you submit, upload, or import, such as names, photos, logos, class descriptions, and messages. You grant Book This Please a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt for formatting, and distribute that content solely to operate, secure, improve, and promote the Services, and to run features you ask us to run, including AI features. This license ends when you delete the content and we have had a reasonable time to remove it from the live Services, except for copies we are required to keep, backups, and content already shared with a client as part of a booking.
You represent that you have the rights to the content you provide, and that it does not violate anyone else’s rights or these terms.
Acceptable use
Do not use the Services to break the law, to mislead clients, to harass anyone, or to collect or use personal information for a purpose the person did not agree to. Do not interfere with the Services, probe or overload them, or access an account, booking, or integration that is not yours. Do not upload content you do not have the right to use, including material imported from a social account. We may remove content or suspend access that breaks these rules.
Accounts and termination
You must be at least 18 to open an account, whether as an instructor or as a client. An instructor who allows a minor to participate in a class is responsible for having the authority to do so. The account holder remains the adult who accepted these terms.
You are responsible for the activity on your account and for keeping access to your email. We may refuse, suspend, or close an account or a page if you break these terms, if we must do so to comply with law, or if the account creates a risk to clients, instructors, or the Services. You may stop using the Services at any time and may ask us to close your account.
Closing an account does not cancel obligations that already exist, including an instructor’s duty to honor or refund bookings under the policy that applied, and a client’s duty to pay amounts already due. We may keep records as described in the Privacy Policy.
Changes to the Services
We may add, change, or remove features, integrations, and plans, including features described in these terms as something the Services may include. We do not promise that a future feature will ship, or that a current feature will remain available in the same form. If we discontinue a paid feature you have already paid us for, we will provide the remedy required by law and by the terms shown at purchase.
Changes to these terms
We may update these terms. We will post the updated version on this page with a new effective date. If a change is material, we will also give notice by email or in the product before the new date, or both. Continued use of the Services after the effective date means you accept the updated terms. If you do not agree, stop using the Services before that date. A change does not rewrite the cancellation, refund, or price terms that were shown for a purchase already made, except where the law requires it.
Disclaimers and limitation of liability
The Services are provided as is and as available. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that an instructor, class, or AI output will meet your needs.
To the extent the law allows, Book This Please is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or personal injury arising from a class or from an instructor’s conduct. If you are a client, our total liability for a claim relating to the Services is limited to the greater of US$100 or the amounts you paid for bookings through the Services in the 12 months before the claim. If you are an instructor, our total liability for a claim relating to the Services is limited to the greater of US$100 or the amounts you paid to us in the 12 months before the claim. Some places do not allow these limits. Where they do not, the limits apply only as far as the law allows.
Indemnification
You will indemnify and hold harmless Can I Watch This Please, LLC and its members, employees, and agents from claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your offerings, your content, your use of the Services, a class or other activity you teach or attend, or your breach of these terms, except to the extent caused by our willful misconduct. An instructor’s duty includes claims by clients about the class, about refunds, and about the instructor’s own policies.
Intellectual property complaints
If you believe content on the Services infringes a copyright or other intellectual property right, email [email protected] with your name and contact information, a description of the work, the URL or other location of the material, a statement that you have a good-faith belief the use is not authorized, a statement under penalty of perjury that the notice is accurate and that you are the owner or are authorized to act, and your physical or electronic signature. We may remove the material and, where appropriate, tell the person who posted it. We may close the accounts of people who repeatedly infringe.
Disputes and arbitration
Please read this section carefully. It affects your rights. Except for a small claim that stays in small-claims court, you and Book This Please agree that any dispute, claim, or controversy arising out of or relating to these terms or the Services will be resolved by binding individual arbitration, and not in court. That includes a dispute about whether a claim is subject to arbitration. The arbitrator decides that question, except that a court may decide whether the class-action waiver below is enforceable.
The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules when the claim is a consumer claim, and under its Commercial Arbitration Rules otherwise. If the AAA will not administer the arbitration, the parties will agree on another administrator, or a court of competent jurisdiction may appoint one. The arbitration will be seated in New York, or held by telephone or video if the rules allow. The arbitrator may award any individual relief a court could award. The decision is final, and a court with jurisdiction may enter judgment on it.
Class-action waiver. You and Book This Please may bring claims against each other only as individuals, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding. If a court finds this waiver unenforceable as to a particular claim, that claim proceeds in court and the rest of this arbitration agreement remains in effect.
Jury waiver. If a claim proceeds in court for any reason, you and Book This Please waive any right to a trial by jury.
Small claims. Either of us may bring an individual claim in small-claims court in New York County or Kings County, New York, or in the small-claims court where you live, instead of arbitration, if the claim qualifies and remains in that court.
30-day opt-out. You may opt out of this arbitration agreement, including the class-action waiver and the jury waiver, within 30 days after you first accept these terms. Email [email protected] with the subject “Arbitration opt-out,” your name, and the email address on your account. Opting out does not affect the rest of these terms. If you opt out, and for any dispute that is not arbitrated, the courts in the Governing law section are the venue.
This arbitration agreement survives the end of these terms and the closing of an account.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Except for a claim that is arbitrated, or a claim that stays in small-claims court, the state and federal courts located in New York County or Kings County, New York, are the exclusive venue for disputes arising out of these terms or the Services.
Assignment
You may not assign these terms without our written consent. We may assign them, including to a successor to the business. These terms bind each party’s permitted successors.
Severability
If a provision of these terms is held unenforceable, the rest stays in effect. That provision will be modified to the minimum extent needed to make it enforceable. The class-action waiver states what happens if it is found unenforceable as to a particular claim.
Entire agreement
These terms, the Privacy Policy, and the price, cancellation, and other terms shown at the time of a purchase are the entire agreement between you and Book This Please about the Services. They replace earlier agreements on the same subject. A waiver or class policy an instructor asks a client to accept is a separate agreement between that instructor and that client.
